Proposed Changes to Air Regulations
The Massachusetts Department of Environmental Protection (MADEP) has recently published
wide-ranging changes to the Department's Air Pollution Control Regulations, 310 CMR 7. Many of
the changes are designed to update obsolete rules and reduce regulation on industrial activities
that cause little or no environmental impact. These changes include revisions to definitions,
twenty additional exceptions to requirements for a plan approval (permit), new procedures for
modifying equipment that has already received plan approval, new provisions that allow an
applicant to begin limited construction activity before the final plan approval is issued, a
new procedure for modifying an existing Restricted Emission Status (RES) approval based on a
notification process, and more flexible visible emission standards.
