The Massachusetts Legislature has directed DEP to increase permit and compliance fees, authorized under section 18 of chapter 21A of the General Laws. DEP is required to adjust fees that have not been modified more recently than fiscal year 1997 to reflect increases in the Consumer Price Index. DEP has revised its fee schedule with increases becoming effective on September 6, 2002 and these changes were promulgated as emergency regulations.

The Department held public hearings on these regulation amendments and the public comment period closes October 18, 2002. These emergency regulations are scheduled to be finalized December 2002.
