Congress Overturns the Ergonomics Standard
Congress has used the Congressional Review Act (CRA), passed in 1996, to toss out the OSHA
ergo standard. Under the CRA, not only is the rule completely thrown out, OSHA is prevented
from ever issuing any "similar" standard. This is the first time that the CRA has been utilized
to overturn a federal rulemaking.
On March 6, the Senate voted 56 to 44 to approve the resolution (S.J. Res. 6) to rescind
the standard. The House voted within 24 hours in a 223-206 vote to overturn the rule.
President Bush signed the bill on March 20. Secretary of Labor Elaine Chao has stated that
she wants to address the concerns that have been raised about the standard and may even
consider new rulemaking.
