Activity and Use Limitation (AUL) Provisions for Massachusetts

Under the MCP, minor errors in existing AULs will be corrected using a newly adopted "confirmatory AUL" document. Interest holders (e.g., utilities, leaseholders, etc.) in AUL-designated areas will be given 45-days notice before new AULs are implemented or existing AULs are modified. Landowners wishing to take additional corrective actions within portions of AUL-designated areas may use a new "partial AUL termination" form to rescind AUL controls in those areas. This streamlined approach may help reduce AUL filing fees at some 21E sites. More serious errors at all AUL sites will require complete AUL termination and resubmission. Errors in an AUL placed on registered land will have no remedy but to terminate the existing AUL and re-file a new AUL.
