Conditional No Exposure Exclusion for Industrial Activity

Effective February 7, 2000, all facilities with industrial activity are eligible to file a No Exposure Certification, exempting the facility from holding a storm water NPDES permit (and related requirements), provided that the facility meets the requirements for no exposure to storm water and is located in states and territories where the EPA is the permitting authority. Operators of facilities which previously had determined that their facility had no exposure to storm water and was exempt from storm water NPDES permitting requirements must complete the No Exposure Certification to remain in compliance. Under the previous regulations, certain light industrial facilities were expected to make an independent determination of whether there was "no exposure" of industrial materials, and if so, no certification statement was required. The No Exposure Certification consists of a four-page form that uses a series of yes/no questions to aid facility operators in determining whether they have a condition of no exposure. It also serves as the necessary certification of no exposure provided the operator is able to answer all the questions in the negative.
