Techno Bits/Technical Bulletins WATER AND WASTEWATER - ARCHIVED Construction Stormwater Permit Extended to Small Construction Activities As of March 10, 2003, all small construction activities (disturbing at least one, but less than five acres) must apply for permit coverage to discharge stormwater associated with construction activities. Large Construction Activities (disturbing five acres or greater) are already subject to permitting. In Massachusetts and New Hampshire, EPA is the permitting authority. Other New England states are authorized to implement the NPDES program for stormwater.
